1. Definitions

In these Terms of Service (“Terms”):

EzBanners, we, us, or our refers to EzBanners.org, owned and operated by Gyvex (KvK: 63536625).
Service refers to the EzBanners website, APIs, hosted banner generation services, plugins, dashboards, and related tools.
User, you, or your refers to any individual or entity using the Service.
Content refers to any data, text, images, server information, or configurations provided by you.
Banner refers to any generated image or visual output produced by the Service.

2. Acceptance of Terms

By accessing or using EzBanners.org, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.

If you are using EzBanners on behalf of an organization, you represent that you have authority to bind that organization.

3. Description of the Service

EzBanners provides tools to generate, host, and serve dynamic banners for Minecraft servers, including:

Real-time or cached server data visualization
Banner templates (free and premium)
Public APIs and endpoints
Optional plugins or integrations
Hosting of generated banner images

EzBanners does not operate or control Minecraft servers themselves.

4. Eligibility

You must be at least 13 years old to use the Service. If local law requires a higher minimum age, you must comply with that law.

5. Accounts and Access

Some features may require account creation.

You are responsible for:

Maintaining the confidentiality of your credentials
All activity under your account
Ensuring that any data you provide is accurate and lawful

EzBanners may suspend or terminate accounts that violate these Terms.

6. Acceptable Use

You agree not to:

Abuse, overload, or disrupt the Service or its infrastructure
Circumvent rate limits, security measures, or access controls
Use the Service for illegal, fraudulent, or misleading purposes
Use EzBanners to distribute malware or malicious content
Resell or rehost the Service without explicit permission
Impersonate EzBanners or claim official affiliation without authorization

Automated usage (including API access) must comply with documented limits.

7. Content and Data

7.1 Your Content

You retain ownership of any Content you provide.

By using the Service, you grant EzBanners a non-exclusive, worldwide, royalty-free license to process, store, and display your Content solely to provide the Service.

7.2 Server Data

You confirm you are authorized to expose that data
EzBanners is not responsible for the accuracy or availability of third-party server information

8. Templates and Intellectual Property

All templates, designs, software, APIs, branding, and documentation provided by EzBanners are protected by intellectual property laws.
Free templates may be used without attribution unless stated otherwise
Premium templates are licensed, not sold
You may not copy, redistribute, or resell templates outside the Service
“EzBanners” and associated branding may not be used without permission.

8.1 Image Copyright & Usage

When you add images to banner designs (uploads, template assets, or linked images) you represent and warrant that you own the copyright to those images or have obtained all necessary licenses, clearances, and permissions for the intended use, including commercial uses where applicable. This includes but is not limited to:

Images you upload directly to the Service;
Images you include in saved templates or share publicly via EzBanners;
Third-party imagery (stock, logos, artwork) embedded or referenced by URLs.

Do not upload or use copyrighted images unless you have the right to do so. Use public-domain images, appropriately licensed stock images, or images you created. If an image is licensed under a Creative Commons or other license that requires attribution or restricts commercial use, you must comply with the license terms and provide required attribution when requested.

EzBanners may remove, disable access to, or refuse to host any image or banner that is the subject of a valid copyright complaint, or that we reasonably believe infringes third-party rights.

8.2 Payouts, Premium Content & Copyright Claims

If you participate in any revenue-sharing, premium template sales, or payout programs facilitated by EzBanners, the following additional rules apply:

You are solely responsible for ensuring that any images or assets used in payout-eligible banners are cleared for the relevant commercial use.
EzBanners may withhold, suspend, or reverse payout disbursements if a banner or template is the subject of a copyright claim, takedown notice, or ownership dispute until the claim is resolved to our reasonable satisfaction.
If you receive payouts for content later found to infringe third‑party rights, you agree that EzBanners may recover those amounts from future payouts or require reimbursement. You remain responsible for any damages, fees, or penalties arising from infringement claims.
To be eligible for payouts, you may be required to provide proof of license or ownership for any disputed images (for example, a license receipt, written permission, or transfer document).
EzBanners reserves the right to suspend accounts, remove content, or terminate services where repeated or serious infringement occurs.

To report copyright issues or request a review, contact us via the official Discord channel and include documentation supporting your rights or your takedown counter-notice where applicable.

9. Paid Plans and Subscriptions (If Applicable)

If you purchase a paid plan:

Fees are billed in advance unless stated otherwise
All payments are non-refundable unless required by law
We may modify pricing with reasonable notice
Failure to pay may result in suspension or downgrade
Taxes may apply depending on your jurisdiction.

10. Availability and Modifications

EzBanners aims for high availability but does not guarantee uninterrupted service.

We may:

Modify or discontinue features
Update templates or APIs
Perform maintenance causing temporary downtime

We are not liable for data loss caused by service changes, outages, or third-party failures.

11. Third-Party Services

The Service may integrate or link to third-party tools, APIs, or libraries.

EzBanners is not responsible for:

Third-party availability or accuracy
Their terms, policies, or behavior

Use of third-party services is at your own risk.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available”.

To the maximum extent permitted by law, EzBanners disclaims all warranties, including:

Fitness for a particular purpose
Non-infringement
Accuracy or reliability of data
Availability or uptime

13. Limitation of Liability

To the maximum extent permitted by law:

EzBanners shall not be liable for:

Indirect or consequential damages
Loss of profits, data, or revenue
Server downtime or banner unavailability
Actions taken based on generated banners or data

Total liability shall not exceed the amount paid by you to EzBanners in the last 12 months, or €0 if no fees were paid.

14. Indemnification

You agree to indemnify and hold EzBanners harmless from claims arising from:

Your use of the Service
Your Content
Your violation of these Terms
Your violation of applicable laws or third-party rights

15. Termination

You may stop using the Service at any time.

EzBanners may suspend or terminate access if:

You violate these Terms
Your usage poses technical or legal risks
Required by law or enforcement requests

Upon termination, licenses granted under these Terms will end.

16. Privacy

Use of the Service is also governed by our Privacy Policy, which explains how data is processed and stored.

17. Changes to These Terms

We may update these Terms from time to time.

Continued use after changes constitutes acceptance

Material changes may be announced via the website

18. Governing Law and Jurisdiction

Unless otherwise required by law:

These Terms are governed by the laws of the Netherlands
Disputes shall be submitted to the competent courts in the Netherlands
